Intellectual Property Rights, Design Protection and Brand Identity
All products, designs, pattern constructions, cuts, techniques, graphic expressions, artistic elements, concepts, collections, visual identities, and the overall design and brand identity of Vera & William are protected by copyright and other intellectual property rights.
This includes, but is not limited to, product design, patterns and pattern constructions, cuts and silhouettes, material combinations, graphic elements, technical solutions, production methods, craftsmanship techniques, aesthetic expressions, as well as the brand’s distinctive design identity, visual characteristics and so-called “trade dress” — including the overall appearance that makes the products recognizable as part of Vera & William.
These rights are the result of more than 25 years of artistic and design development and market activity and belong exclusively to the rights holder.
The purchase or acquisition of any product from Vera & William does not grant any rights to copy, reproduce, imitate, adapt, analyze, reverse-engineer, further develop, or otherwise exploit the designs, patterns, techniques, constructions, or other creative solutions underlying the products. This applies to both direct copying and any form of imitation or adaptation that may be considered to build upon Vera & William’s design, concept, or expression.
It is strictly prohibited to:
- copy or reproduce Vera & William’s products, designs, or patterns
- imitate or develop products based on Vera & William’s design expression or construction
- attempt to recreate or analyze technical solutions or pattern constructions through so-called reverse engineering
- use Vera & William’s designs, concepts, or aesthetic expressions as the basis for products developed by oneself or by third parties
- disclose or make available design materials, technical solutions, or other protected information to any third party
Any unauthorized copying, imitation, or commercial or non-commercial exploitation of Vera & William’s designs, concepts, or product development constitutes a serious violation of applicable intellectual property laws.
Such actions will be pursued through legal action and may result in claims for damages, financial compensation, cessation of production and distribution, seizure of goods, as well as further legal sanctions in accordance with applicable national and international legislation, including but not limited to:
- Åndsverkloven
- Designloven
- Varemerkeloven
- Markedsføringsloven, including provisions relating to unlawful imitation and unfair competition.
All intellectual property rights, including designs, concepts, trademarks, distinctive characteristics, and brand identity, remain at all times the exclusive property of Vera & William unless otherwise expressly agreed in writing.
Vera & William reserves the right to take all necessary legal action to protect its rights nationally and internationally. Any deliberate imitation or unauthorized use of Vera & William’s design expression will be considered a violation of intellectual property rights and will be pursued without further notice.
